NOTICE OF SANCTION
Background
- Pursuant to section 4.1(b) of the Rules and Procedures for the Election of the BC Conservative Party Leader (the “Rules”), each Leadership Contestant was required to pay the Third Fee of $40,000 on or before April 1, 2026.
- The Peter Milobar Campaign’s Financial Agent sent a photograph of a cheque to Party staff on March 29, 2026, indicating the cheque was on its way to the Party Office by way of regular (unregistered) mail.
- The Party received the Peter Milobar Campaign’s Third Fee on April 2, 2026, one day after the prescribed deadline and contrary to the Rules, which was brought to the attention of the Leadership Election Organizing Committee (“LEOC”).
Rules
- Pursuant to section 5.1(a) of the Rules, every Leadership Contestant is required to make every payment within the time prescribed.
Sanction
- LEOC has issued a fine of $7,500 against the Peter Milobar Campaign.
- This fine will be imposed against the Peter Milobar Campaign’s $20,000 Compliance Deposit pursuant to section 4.3 of the Rules. The Campaign has 7 days to replenish the Compliance Deposit to $20,000.
- LEOC acknowledges that the Peter Milobar Campaign’s Financial Agent is a volunteer who appears to have made reasonable efforts to meet the stipulated deadline, has met every other financial deadline, and did not otherwise intentionally violate the Rules. However, it is the responsibility of each campaign and ultimately each Leadership Contestant to ensure all fees are delivered by the applicable deadline. The Third Fee was delivered late contrary to section 5.1(a) of the Rules, and merits the above described sanction.
